Terms of Service

1. Acceptance of Terms
By accessing or using the ESP Hotel website at esphotels.com (the “Site”) or by making a booking or enquiry through the Site, you (“you”, “your”, “the guest”) agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use the Site.
These Terms apply to all visitors, guests, and others who access or use the Site. They form a legally binding agreement between you and ESP Hotel.
2. About ESP Hotel
ESP Hotel is a boutique hotel located at 51 Ndabaningi Sithole Road, Labone, Accra, Ghana. We provide accommodation, dining, spa and wellness, and event services. Our reservations telephone is +233 (54) 897 4174 and our general enquiries email is info@esphotel.com.
3. Use of the Site
You may use the Site for lawful purposes only. You agree not to:
- Use the Site in any way that violates applicable local, national, or international law or regulation
- Submit false, misleading, or fraudulent information through any form on the Site
- Attempt to gain unauthorised access to any part of the Site, our servers, or any database connected to the Site
- Use automated scripts, bots, scrapers, or crawlers to extract data from the Site without our prior written consent
- Transmit any unsolicited or unauthorised advertising or promotional material
- Interfere with or disrupt the integrity or performance of the Site or its infrastructure
- Introduce viruses, trojans, worms, or other malicious code
- Harvest or collect personal data about other users
We reserve the right to restrict or terminate access to the Site at our sole discretion, without notice, for conduct that we determine violates these Terms or is otherwise harmful to us, other users, or third parties.
4. Bookings and Reservations
Reservation requests, not confirmations. Submitting a booking or enquiry through the Site constitutes a request for a reservation, not a confirmed booking. A reservation is confirmed only when you receive a written confirmation from ESP Hotel — typically by email.
Confirmation email governs. The specific rate, cancellation policy, deposit requirements, and other terms applicable to your reservation are set out in the confirmation email you receive. In the event of any conflict between these Terms and your confirmation email, the confirmation email prevails in respect of your specific booking.
Cancellations. Cancellation terms vary by rate type and are specified in your confirmation. As a general guide: flexible rates may be cancelled without charge up to 48 hours before arrival; advance-purchase rates are non-refundable. Your confirmation email is the authoritative source for your booking's cancellation policy.
No-shows. If you do not arrive by the scheduled check-in time without prior notice, we may treat your reservation as cancelled and re-let the room. Any applicable no-show charge will be set out in your confirmation.
Right to decline. We reserve the right to decline or cancel any reservation at our discretion, including where a rate was published in error. In such cases we will notify you promptly and any deposit paid will be returned in full.
Age requirement. You must be at least 18 years old to make a booking through the Site.
5. Pricing and Currency
Prices displayed on the Site are in Ghana Cedis (GHS) unless otherwise stated. International guests should be aware that exchange rates and bank fees may apply when paying from abroad.
Prices are subject to change without notice and do not include taxes or levies unless expressly stated. Applicable taxes and any tourism-related levies will be communicated to you before your booking is confirmed.
We make every effort to ensure that prices shown on the Site are accurate. If we discover a pricing error after you have submitted a booking request, we will contact you as soon as possible. You will have the option to proceed at the correct price or cancel without charge.
6. Intellectual Property
All content on the Site — including but not limited to text, photography, video, graphics, logos, branding, and software — is owned by or licensed to ESP Hotel and is protected by copyright, trademark, and other intellectual-property laws of Ghana and applicable international conventions.
You may view, print, and download content from the Site for your own personal, non-commercial use only. You may not reproduce, distribute, republish, adapt, transmit, or create derivative works from any content on the Site without our prior written consent.
The ESP Hotel name, logo, and trade dress are trademarks of ESP Hotel. Nothing in these Terms grants you any right to use our trademarks.
7. Acceptable Use
The Site is provided for the purpose of obtaining information about ESP Hotel's services, making accommodation and service enquiries or reservations, and communicating with our team. Any other use requires our express written consent.
You are responsible for ensuring that any information you submit is accurate, truthful, and up to date. Submitting false information in connection with a booking may result in cancellation without refund and, where applicable, referral to relevant authorities.
8. Disclaimers
The Site and its content are provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, ESP Hotel makes no warranties, express or implied, regarding the Site, including but not limited to:
- That the Site will be uninterrupted, error-free, or free of viruses
- That information on the Site is complete, accurate, or current
- Fitness for any particular purpose
Links to third-party websites are provided for convenience only. ESP Hotel does not endorse, control, or accept responsibility for the content of any linked site.
9. Limitation of Liability
To the fullest extent permitted by the laws of Ghana, ESP Hotel, its officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Site or any booking made through it, including loss of profits, loss of data, or loss of goodwill.
Our total aggregate liability to you in connection with the Site shall not exceed the amount paid by you to ESP Hotel in the 12 months preceding the event giving rise to the claim, or GHS 500 (whichever is greater).
Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
10. Indemnity
You agree to indemnify, defend, and hold harmless ESP Hotel and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the Site; (b) your breach of these Terms; or (c) any false or misleading information you provide in connection with a booking or enquiry.
11. Governing Law and Disputes
These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Republic of Ghana.
In the event of a dispute, we encourage you to contact us first at info@esphotel.com so that we can attempt to resolve the matter informally. If we are unable to reach a resolution within 30 days, either party may refer the dispute to the competent courts of Ghana.
12. Changes to These Terms
We reserve the right to modify these Terms at any time. When we make material changes we will update the “Effective date” at the top of this page. If you continue to use the Site after updated Terms have been posted, you are deemed to have accepted the changes. We recommend that you review this page periodically.
